Gift Certificate Terms & Conditions

Effective Date: September 9, 2025

These Terms & Conditions govern the purchase, delivery, use, and redemption of massage gift certificates ("Certificates") issued by New Mercies Massage LLC ("we," "us," or "our"). By purchasing, receiving, or redeeming a Certificate, you ("you," "purchaser," or "recipient") agree to be legally bound by these Terms.

1. Purchase & Payment

• Certificates may be purchased online through our website or directly from the Studio.

• Payment is due in full at the time of purchase.

• Accepted payment methods include card payments via Stripe, Inc. and other methods as offered.

• All prices are listed in U.S. dollars (USD).

• Once payment is processed, the purchaser will receive a confirmation email with Certificate details.

• All sales are final. Certificates are non-refundable to the maximum extent permitted by law.

2. Delivery of Certificates

• Certificates may be delivered electronically via email or physically in-person pickup.

• Electronic delivery will be made to the email address provided at purchase. The purchaser is responsible for accuracy of the email address.

• Delivery times for physical Certificates may vary. We are not responsible for delays, loss, or errors in delivery by third parties (electronic).

• Risk of loss passes to the purchaser upon delivery.

3. Redemption

• Certificates may be redeemed solely for massage services offered by New Mercies Massage LLC at 417 S Buncombe Rd, Ste 4, Greer, SC 29650.

• Certificates are not redeemable for cash, credit, or gratuities.

• Certificates may not be used to purchase other Certificates.

• Certificates must be presented (printed or electronic) at the time of the appointment.

• Appointments are subject to therapist availability and must be scheduled in advance.

• If the service cost exceeds the Certificate value, the balance must be paid by the recipient.

• Certificates may not be combined with discounts, memberships, or promotions unless explicitly stated in writing.

4. Validity & Expiration

• Certificates are valid for 6 months from the date of purchase, unless otherwise stated in writing.

• Expired Certificates will not be honored, extended, or refunded.

• It is the sole responsibility of the recipient to redeem the Certificate before expiration. We do not send expiration reminders.

5. Transfer & Resale

• Certificates are generally non-transferable.

• Resale or unauthorized distribution is strictly prohibited without our written consent.

• We reserve the right to refuse redemption of Certificates obtained through unauthorized resale or fraud.

6. Lost, Stolen, or Damaged Certificates

• Treat Certificates like cash. We are not responsible for lost, stolen, destroyed, or unauthorized use of Certificates.

• Replacement is not guaranteed. At our discretion, we may reissue an electronic Certificate only if verifiable purchase details are provided. Administrative fees may apply.

7. Cancellations & No-Shows

• Our standard cancellation policy applies to all appointments booked with Certificates.

• 48 hours’ notice is required for cancellations or reschedules. Failure to provide notice will result in the forfeiture of the applicable Certificate value.

• No-shows result in forfeiture of the full Certificate value.

• Standard cancellation policies are available on our website and may change without notice.

8. Refunds

• Certificates are non-refundable once issued, except as required by law.

• Unused or partially used Certificates have no cash value and will not be refunded or credited.

9. Limitation of Liability

• To the maximum extent permitted by law, our liability in connection with Certificates is limited to the purchase price of the Certificate.

• We are not liable for indirect, incidental, or consequential damages arising from purchase, delivery, or use of Certificates.

• Use of Certificates constitutes acceptance of all risks associated with massage therapy services.

10. Fraud & Misuse

• We reserve the right to reject, suspend, or cancel any Certificate suspected of being obtained through fraud, unauthorized use, or violation of these Terms.

• Fraudulent use may result in refusal of service, cancellation of the Certificate without refund, and potential legal action.

11. Changes to Terms

• We may update or modify these Terms at any time without prior notice.

• Current Terms will be posted on our website. Continued use or redemption of Certificates constitutes acceptance of updated Terms.

12. Governing Law & Dispute Resolution

• These Terms are governed by the laws of the State of South Carolina.

• Any disputes shall first be attempted to be resolved informally with the Studio.

• If unresolved, disputes shall be resolved by binding arbitration in Greenville, South Carolina, except where prohibited by law. Class actions are waived.

• Either party may pursue claims in small claims court where applicable.
