Massage Therapy Terms & Conditions

By booking, paying for, or receiving massage services from New Mercies Massage LLC ("the Studio," "we," "us," or "our"), you ("Client," "you," or "your") agree to the following legally binding Terms & Conditions. Please read carefully, as they affect your rights and obligations.

1. Appointments, Cancellations & Late Arrivals

• Scheduling: Appointments must be scheduled in advance and are subject to therapist availability.

• Cancellation Policy: A minimum of 48 hours’ notice is required to cancel or reschedule without penalty.

• Fees:

  • Cancellations with less than 24 hours’ notice may be charged up to 100% of the scheduled service fee.

  • New clients must provide a 50% non-refundable deposit at booking; deposits are applied to the final balance.

• Late Arrivals: Sessions will end at the originally scheduled time. The full fee remains due, regardless of shortened service.

• No-Shows: Failure to appear without notice will result in a charge of 100% of the scheduled service fee. Repeated no-shows may result in termination of services.

• Studio Cancellations: New Mercies Massage, LLC reserves the right to cancel or reschedule appointments due to illness, emergency, or events beyond our control. In such cases, deposits will be applied to a rescheduled appointment.

2. Health & Medical Information

• Disclosure: You must provide accurate, complete health information prior to your session and update us of any changes.

• Contraindications: Certain health conditions may prevent or limit massage therapy. We may request a physician’s clearance before treatment.

• No Substitution for Medical Care: Massage is not a replacement for medical diagnosis or treatment. Consult your physician for medical concerns.

• Illness: If you are ill, experiencing fever, or have a contagious condition, you must reschedule. We reserve the right to decline service if illness is suspected, and cancellation fees may apply.

• Pregnancy: If pregnant, you must notify us when booking; pregnancy massage will only be performed when deemed safe and may be subject to restrictions.

3. Professional Conduct & Boundaries

• Respectful Environment: A safe, professional atmosphere is maintained at all times.

• Inappropriate Behavior: Sexual, suggestive, aggressive, or disrespectful behavior will result in immediate termination of the session, full payment due, and possible permanent ban from services.

• Draping & Privacy: Professional draping is required at all times.

• Client Rights: You may request adjustments, modifications, or termination of the session at any time.

4. Payment & Fees

• Due at Service: Full payment is required at the time of service.

• Deposits: A 50% deposit is required for all new clients to secure appointments. Deposits are non-refundable except when canceled by the Studio.

• Accepted Methods: Cash, card, check, Venmo, Zelle, and Cash App. Returned payments, chargebacks, or NSF transactions may incur additional administrative fees.

• Price Changes: Prices are subject to change at the Studio’s discretion with or without prior notice. Current pricing will always be honored once a session is booked and confirmed.

5. Liability & Assumption of Risk

• Acknowledgment of Risk: By receiving massage therapy, you acknowledge and voluntarily assume all risks associated with massage, including but not limited to temporary soreness, bruising, or other minor side effects.

• Release of Liability: To the maximum extent permitted by law, you release and hold harmless New Mercies Massage LLC and its staff from any claims, damages, or liabilities arising from massage services, except in cases of gross negligence or willful misconduct.

• Personal Property: We are not responsible for loss, theft, or damage to personal belongings brought into the Studio.

6. Confidentiality & Records

• Confidentiality: All client information, intake forms, and session notes are strictly confidential and will not be shared except as required by law.

• Record Retention: Client records are maintained securely in compliance with applicable privacy laws.

7. Consent to Treatment

• By booking and receiving massage services, you confirm that:

  • The information provided on your intake form is accurate and complete.

  • You consent to receive massage therapy from New Mercies Massage LLC.

  • You understand that massage therapy is not a substitute for medical treatment.

  • You release the Studio from liability as described in Section 5.

8. Termination of Services

• We reserve the right to refuse or discontinue services at any time, including but not limited to violations of these Terms, unsafe health conditions, or inappropriate behavior. In such cases, no refunds will be issued.

9. Changes to Terms & Conditions

• We may update or modify these Terms at any time. Updated Terms will be posted at the Studio and/or on our website. Continued use of services constitutes acceptance of revised Terms.

10. Governing Law & Dispute Resolution

• These Terms are governed by and construed under the laws of the State of South Carolina.

• Dispute Resolution: In the event of a dispute, you agree to first attempt informal resolution with the Studio. If unresolved, disputes shall be settled by binding arbitration in Greenville, South Carolina, except where prohibited by law. Class action rights are waived.

• Small Claims: Either party may pursue claims in small claims court where jurisdictional limits apply.
